Flex Scorebook Terms of Service

Effective Date: August 4, 2026 Service: Flex Scorebook Operator: Fastpitch Authority Contact: support@fastpitchauthority.com These Terms of Service ("Terms") govern access to and use of Flex Scorebook, including its scorekeeping software, public team pages, roster and claim features, player cards, and related websites and services (collectively, the "Service"). By creating an account, clicking to accept these Terms, or using the Service, you agree to them. If you do not agree, do not use the Service. Flex Scorebook and Fastpitch Authority use one login system and one underlying database. Information entered through the Service may be used in or appear in Fastpitch Authority features under the Fastpitch Authority privacy notice. ## 1. Eligibility and Authority The Service is intended for adults. You must be at least 18 years old, or the age of majority where you live, to create an account or act as a coach, team administrator, parent, or guardian. A parent or legal guardian must act for a child in the claim, consent, and privacy-rights processes. You represent that the information you provide is accurate, that you have authority to create or manage the team or account you identify, and that you will promptly correct information that becomes inaccurate. A coach's authority to manage a team does not make the coach a parent or legal guardian and does not authorize the coach to give parental consent for an athlete. ## 2. Accounts and Security You are responsible for keeping your login credentials confidential and for activity through your account. Do not share a password, use another person's account, or allow an unauthorized person to access the Service. Notify us promptly at support@fastpitchauthority.com if you believe an account or claim link has been misused. We may require identity or authority verification before processing a claim, granting access to an athlete record, responding to a privacy request, or changing a guardian relationship. ## 3. Scorekeeping and Public Team Pages The Service lets a coach record games offline and synchronize them when a connection becomes available. We use those records to generate box scores, play-by-play information, and per-athlete and season statistics. Each team may have a public page that is viewable without a login and may be indexed by search engines. A public page may show a team name, logo, photograph, roster names, jersey numbers, positions, game results, box scores, and per-athlete lines. A player card is public only when the family has claimed the athlete and chosen to publish it. Venue and game start time are not displayed on public team pages. Public pages are intended for sports information, not for contacting, locating, or monitoring a child. You may not use the Service to publish a child's contact information, home address, precise location, school schedule, venue, game start time, or other information that creates an unreasonable safety risk. ## 4. Roster Stubs and Claim Links A coach may create a roster stub by entering an athlete's first name, last name, and jersey number before a parent or guardian has claimed the record. The coach may use the stub to prepare a roster and score a game. Creating a roster stub is not parental consent and does not give the coach authority to make decisions reserved to a parent or guardian. The coach may send a claim link to the family through a private team communication channel. The coach must not post a claim link publicly or transfer it to a person who is not authorized to act for the athlete. The person claiming an athlete must accurately identify their relationship and may be required to complete verification. After a valid claim, the coach may update the jersey number and may perform only the team-management actions that the Service permits. The coach may not change an athlete's identity, guardian relationship, personal profile, consent status, photograph, video, or other family-controlled information. The coach may not create a roster record for a real or fictional athlete without a legitimate team or scorekeeping purpose, create a duplicate record to evade a restriction, or claim an athlete to themselves or another person without authority. ## 5. Coach Responsibilities If you use the Service as a coach or team administrator, you agree to: - Collect and submit only the information reasonably needed for roster management and scorekeeping; - Follow the Coach Agreement and all applicable privacy, child-safety, publicity, and intellectual-property laws; - Provide families a clear and private route to the claim flow; - Avoid treating your team role as parental consent; - Obtain and record any required consent before submitting photographs, videos, or other media; - Avoid submitting venue and game start time for public display, and not attempt to bypass the Service's controls; - Review roster and game data for accuracy and promptly report an incorrect or unauthorized record; and - Cooperate with a parent, guardian, athlete, or our support team when a record is disputed, suppressed, corrected, or deleted. ## 6. Prohibited Conduct You may not: - Use the Service unlawfully, fraudulently, or to harm or endanger a child; - Impersonate a parent, guardian, athlete, coach, or team administrator; - Link yourself or another person to an athlete without authority; - Publish a player card or other family-controlled profile for an unclaimed athlete; - Upload, request, or publish media of an athlete without the required permission or consent; - Enter fabricated, retaliatory, defamatory, or intentionally misleading roster or performance data; - Attempt to bypass age, consent, access-control, visibility, or media restrictions; - Scrape, harvest, sell, or commercially exploit public athlete or team information; - Reverse engineer, interfere with, or overload the Service; - Use a public page to identify a child's location, schedule, contact information, or other sensitive information; or - Use the Service to send unsolicited communications to a child. ## 7. Content, Statistics, and Permissions You retain rights you hold in content you submit, subject to the rights of the athlete, parent, guardian, team, league, and other persons whose information appears in that content. You grant Fastpitch Authority a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, process, and transmit the content only as reasonably necessary to operate, secure, support, and improve the Service and to provide the public pages and features you request. This license does not give a coach ownership of an athlete's personal information and does not replace any consent required by law. A coach may not grant rights that belong to an athlete, parent, guardian, school, league, photographer, or other rights holder. The Service may calculate statistics from scorekeeping data. Statistics can contain errors caused by incomplete or incorrect inputs, synchronization problems, or other technical limitations. You are responsible for reviewing important records before relying on them. We may create and use de-identified or aggregated statistics that do not reasonably identify an individual, subject to the Privacy Policy and applicable law. ## 8. Privacy and Consent Our Privacy Policy and Children's Privacy Notice explain how we handle information. Our consent records are append-only: a new consent or revocation does not rewrite prior history. Revocation does not necessarily undo disclosures that already occurred, but it will control future processing where applicable. Photo and video playback is blocked when required consent is missing or declined. You must not attempt to upload or submit media without the required consent, even if a technical upload feature appears available. ## 9. Subscriptions and Payments Flex Scorebook has a free plan and paid plans. Paid plans are governed by the Subscription Terms, which are incorporated into these Terms. The Subscription Terms explain pricing, annual automatic renewal, cancellation, renewal reminders, and refund rules. One subscription may cover every athlete linked to the purchasing account, subject to the applicable plan and the restrictions in these Terms. A subscription does not give the purchaser ownership of an athlete's personal information or authority to override a parent, guardian, or athlete privacy request. ## 10. Service Changes and Availability We may modify, suspend, or discontinue all or part of the Service, including a public page or feature, when reasonably necessary for security, legal compliance, maintenance, product development, or business reasons. Offline functionality depends on the device and may not synchronize until service returns. We do not guarantee uninterrupted availability, error-free statistics, permanent storage, search-engine indexing, or that a public page will remain available. We may hide, restrict, correct, or delete information that is inaccurate, unauthorized, unsafe, unlawful, or inconsistent with these Terms. ## 11. Suspension and Termination We may suspend or terminate access when we reasonably believe an account has violated these Terms, the Coach Agreement, a consent or safety requirement, or applicable law; when access creates a risk to a child, person, or system; or when needed to respond to a dispute or legal request. We may also close an account at the account holder's request. If access ends, the Privacy Policy governs retention and deletion. Subscription cancellation is governed by the Subscription Terms. Sections that by their nature should survive termination, including intellectual-property, disclaimers, limits of liability, dispute, and enforcement provisions, survive. ## 12. Disclaimers TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." FASTPITCH AUTHORITY DISCLAIMS WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, COMPLETE, OR FIT FOR A PARTICULAR PURPOSE. WE DO NOT PROVIDE MEDICAL, LEGAL, RECRUITING, OR SAFETY ADVICE, AND PERFORMANCE DATA IS NOT A GUARANTEE OF ATHLETIC OUTCOME, SCHOLARSHIP, SELECTION, OR EMPLOYMENT. Nothing in these Terms limits a right or remedy that cannot lawfully be limited, including rights under applicable consumer-protection or privacy law. ## 13. Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY LAW, FASTPITCH AUTHORITY AND ITS SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, REVENUE, GOODWILL, OR OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR $100. These limits do not apply where prohibited by law, or to liability that cannot be limited by law. ## 14. Governing Law and Dispute Resolution These Terms and any dispute or claim arising out of or related to them or the Service will be governed by and construed in accordance with the laws of the State of Alabama, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Alabama, in each case located in Winston County, Alabama. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts. ## 15. Changes to these Terms We may update these Terms by posting a revised version and changing the "Last updated" date. For a material change, we will provide additional notice when required by law. Continued use after the effective date means the updated Terms apply, except where applicable law requires a new acceptance. ## 16.
